Terms and Conditions

1. Identification and purpose

In compliance with the duty to provide information set out in Article 10 of Law 34/2002 on Information Society Services and Electronic Commerce (LSSI-CE), the following details are provided:

These terms govern access to the website, the contracting of services, and the purchase of software licenses marketed by Consultoría EHERO SLU (hereinafter, “EHERO”). Placing an order implies the User’s express acceptance of these terms.

2. Services and products offered

2.1. EHERO offers consulting services in web design, digital marketing, and business development, available through the website.

2.2. EHERO also markets licenses for its own software — plugins and modules for e-commerce platforms and content management systems — whose specific terms are set out in sections 6 to 9 of this document.

2.3. The description, features, and technical requirements of each product are shown in its corresponding listing. It is the User’s responsibility to check that their installation meets the stated requirements before contracting.

3. Contracting process

3.1. Contracting is carried out by completing the forms available on the website and making payment using one of the available methods.

3.2. Once payment has been confirmed, EHERO will send the User, to the email address provided, the order confirmation and, in the case of software licenses, the relevant license key.

3.3. The User is responsible for the truthfulness and accuracy of the data provided, in particular the email address, which serves as the means of communication and license identification in accordance with section 6.

4. Prices and payment terms

4.1. Prices are shown in euros and include or exclude applicable taxes as indicated in each listing and during the purchase process.

4.2. By submitting the order form, the User accepts the prices shown.

4.3. Accepted payment methods are credit or debit card (Visa, MasterCard, American Express), PayPal, and bank transfer.

4.4. EHERO will issue the corresponding invoice and send it to the email address provided.

5. Security in payment operations

5.1. EHERO guarantees that the transmission of personal and financial data takes place in secure environments, applying appropriate technical and organizational measures in accordance with data protection regulations.

5.2. Payment data are processed directly by the corresponding entities and payment gateways; EHERO does not store the full card details of its Users.

6. Software licenses

6.1. The plugins and modules marketed by EHERO are granted under a non-exclusive and non-transferable right of use, for the period and number of installations indicated in the order. Under no circumstances is ownership of the software transferred.

6.2. The license is issued in the User’s name and is linked to the email address provided during contracting, which acts as the license identifier. The User is responsible for keeping that address operational and up to date, as it is the channel through which the license key, expiry notices, and service-related communications are sent. Changes of address must be reported to soporte@consultoriaehero.com.

6.3. The license is activated on the domain or domains indicated by the User, within the number of installations contracted. A domain change may be requested at soporte@consultoriaehero.com.

6.4. Assignment, resale, sublicensing, distribution, or making the software or license key available to third parties is prohibited, as is decompilation, reverse engineering, or unauthorized modification, except where legally permitted.

6.5. When the license has been purchased through an authorized distributor or partner, that party may have provided EHERO with the User’s email address and identifying data for the purpose of issuing the license in the User’s name, activating it, and providing associated support. In such case, EHERO is responsible for processing such data for license management, regardless of whether the financial contract was formalized with the distributor.

7. License verification

7.1. For its operation, the software periodically communicates with EHERO’s servers in order to verify the validity of the license, check the number of active installations, prevent unauthorized use, and make available to the User any updates.

7.2. During such verification, only the technical data necessary for that purpose are transmitted: the license key, the associated email address, the installation domain, the software version, and the technical data of the environment (version of the e-commerce platform, content management system, and PHP), as well as the IP address and the date and time of the request.

7.3. EHERO does not access in any case the contents of the User’s store or the data of its customers, orders, products, or any other business information, unless the User expressly requests it in the context of a support intervention.

7.4. This verification is an inseparable part of the operation of the licensed software and cannot be disabled. The verification log is retained while the license remains valid and for the legally applicable limitation periods.

8. Term, expiry, and cessation of operation

8.1. The license lasts for the period indicated in the order. In good time before expiry, EHERO will send the User one or more renewal notices to the email address associated with the license.

8.2. The User is expressly informed that, once the license expires without being renewed, the software will stop working and any synchronizations or automated operations it performs will cease. The software may remain installed, but it will not execute its functions.

8.3. Cessation of operation does not remove the information previously incorporated into the User’s store (products, prices, stock, and other data already synchronized), which will remain as it was at the time of expiry and will no longer be updated.

8.4. By reactivating the license, the software resumes operation and retains the existing configuration, updating itself on the first subsequent synchronization.

8.5. Subscription renewal will take place automatically at the end of the contracted period. If the User does not wish to continue the subscription, they must cancel the renewal from their user panel before the corresponding renewal date.

  1. Updates and support

9.1. During the term of the license, the User is entitled to the software updates published by EHERO.

9.2. The license includes support for the installation and startup of the software, as well as review of its configuration. It does not include custom feature development, ongoing and/or periodic support, adaptation to third-party themes, templates or modules, resolution of issues unrelated to the software, data migration, or general administration of the User’s store, services which may be contracted separately.

9.3. EHERO does not guarantee the operation of the software when the failure originates in services, credentials, application programming interfaces (API), or third-party infrastructure beyond its control, under the terms set out in section 10.

9.4. EHERO may modify, evolve, or discontinue software features, informing the User in reasonable advance when the change is substantial.

10. Refund policy

10.1. If the User has problems getting the plugin they purchased to work, EHERO will be happy to offer a full refund within fourteen (14) calendar days after the original purchase, provided that such problems cannot be resolved by EHERO’s technical support team.

10.2. Before granting a refund, the User must allow EHERO to attempt to resolve the issue, first contacting our technical support team via the email address soporte@consultoriaehero.com. If EHERO’s technical support team manages to resolve the issue and the plugin can work properly, such resolution will not constitute grounds to request or grant a refund.

10.3. No refund will be issued when the inability to install, configure, or use the plugin is due to causes beyond EHERO’s control, including, among others, the failure of third parties to provide credentials, access keys, API Keys, Web Service credentials, segmentation tokens, the deactivation or unavailability of web services or APIs, restrictions imposed by third parties, or any other external circumstance that prevents the proper operation or integration of the plugin.

10.4. After fourteen (14) calendar days from the original purchase, no refunds will be made.

10.5. Refunds do not apply to license updates or renewals.

11. Right of withdrawal (consumer Users)

11.1. Where the User is a consumer or user under Royal Legislative Decree 1/2007, they shall have a period of fourteen (14) calendar days to withdraw from the contract without needing to provide any justification.

11.2. In the case of digital content not supplied on a tangible medium, the User acknowledges and accepts that, by requesting immediate delivery of the license key and the software, the right of withdrawal expires once performance has begun, in accordance with Article 103(m) of the aforementioned Royal Legislative Decree. EHERO will obtain such express consent during the purchase process.

11.3. Withdrawal may be communicated to info@consultoriaehero.com.

11.4. This section does not apply to Users contracting in the course of their business or professional activity.

12. Personal data protection

12.1. Data controller: Consultoría EHERO SLU, NIF B72671100, Rúa Emilia Pardo Bazán 25 A2, 36204 Vigo (Pontevedra) — info@consultoriaehero.com.

12.2. Purposes and legal bases. The data provided are processed to: manage the contractual relationship and invoicing; issue, activate, and verify the contracted licenses; provide associated support; and comply with applicable legal obligations (performance of the contract and legal obligation). Fraud prevention and the protection of intellectual property rights are based on EHERO’s legitimate interest.

12.3. Service communications. EHERO will send the User, to the email address associated with their license, the communications necessary for the proper provision of the service: expiry and renewal notices, security incidents, relevant changes to the software or these terms, and notices about the status of their license or installation —including prolonged absence of license verification, which may indicate that the software is deactivated or uninstalled—. These communications form part of the contracted service and do not constitute advertising.

12.4. Commercial communications. EHERO may send the User information about its own products and services similar to those contracted, in accordance with Article 21.2 of the LSSI-CE. The User may object at any time, easily and free of charge, by using the link included in each communication or by writing to info@consultoriaehero.com. Objection to commercial communications does not affect the service communications in the previous section.

12.5. Rights. The User may exercise their rights of access, rectification, erasure, objection, restriction, and portability by contacting info@consultoriaehero.com, as well as file a complaint with the Spanish Data Protection Agency (www.aepd.es).

13. Intellectual and industrial property

13.1. All content on the website (texts, graphics, images, logos, trademarks, structure, and design), as well as the software marketed and its source code, are the property of EHERO or its licensors and are protected by intellectual and industrial property laws.

13.2. Reproduction, distribution, public communication, or transformation is prohibited without the express written authorization of EHERO.

14. Liability

14.1. EHERO shall not be liable for damages arising from telecommunications interference, system failures, computer viruses, or any other causes beyond its control.

14.2. EHERO is not responsible for damages resulting from use of the software contrary to its documentation, unauthorized modifications, incompatibility with unsupported third-party software, or the User’s failure to make backups. The User is advised to keep updated backups before installing or updating any software.

14.3. Except in cases of willful misconduct or gross negligence, and without prejudice to the rights of the consumer User, EHERO’s liability shall be limited to the amount paid by the User for the relevant license or service.

15. Modifications

15.1. EHERO reserves the right to modify the website’s content, services, and presentation.

15.2. Changes to these terms affecting active licenses will be communicated to the User at the associated email address at least thirty (30) days before they take effect. If the User does not agree, they may notify EHERO within that period.

16. Right of exclusion

16.1. EHERO reserves the right to deny or withdraw access to the portal and services, without prior notice, from Users who breach these terms, without prejudice to any legal actions that may correspond.

17. Applicable law and jurisdiction

17.1. These terms are governed by Spanish law.

17.2. For Users who are consumers, the court having jurisdiction shall be the one corresponding to their place of residence. For all other Users, the parties submit to the Courts and Tribunals of Vigo (Pontevedra), expressly waiving any other jurisdiction.
